जनहित याचिका है? 

जनहित याचिका मानव अधिकारों और समानता को आगे बढ़ाने या व्यापक सार्वजनिक चिंता के मुद्दों को उठाने के लिए कानून का उपयोग है। ‘जनहित याचिका की अवधारणा अमरीकी न्यायशास्त्र से ली गई है। भारतीय कानून में पीआईएल का मतलब जनहित की सुरक्षा के लिए याचिका या मुकद्दमा दर्ज करना है। यह पीड़ित पक्ष द्वारा नहीं, बल्कि स्वयं न्यायालय या किसी अन्य निजी पक्ष द्वारा विधिक अदालत में पेश किया गया मुद्दा है। यह न्यायिक सक्रियता के माध्यम से अदालतों द्वारा जनता को दी गई शक्ति है । इसे केवल सर्वोच्च न्यायालय या उच्च न्यायालय में दायर किया जा सकता है। यह रिट याचिका से अलग है।

Public Interest Litigation?

Public interest litigation is the use of law to advance human rights and equality or to raise issues of wider public concern. The concept of ‘Public Interest Litigation’ has been taken from American jurisprudence. PIL in Indian law means filing a petition or lawsuit for the protection of public interest. It is not the aggrieved party but the issue presented in the court of law by the court itself or any other private party. It is a power given to the public by the courts through judicial activism.
